Terms of Service

These Terms of Service ("Terms") govern your access to and use of Chattery (the "Service"), operated by Chattery ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.
1. Eligibility
You must be at least 16 years old and able to form a binding contract in your jurisdiction to use Chattery. If you use Chattery on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Your Account
You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us promptly if you suspect unauthorized access.
3. Acceptable Use
You agree not to:
- Violate any applicable law or regulation.
- Use the Service to create content that is unlawful, defamatory, harassing, or infringes any third-party rights.
- Use the Service to impersonate any person or misrepresent your affiliation.
- Attempt to probe, scan, or test the vulnerability of the Service without our prior written consent.
- Use the Service to generate spam, phishing content, or malware.
- Reverse engineer, decompile, or attempt to extract the source code of the Service.
4. Your Content
You retain ownership of content you submit to Chattery, including knowledge documents, prompts, and conversation data ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, process, and display Your Content solely to operate the Service for you. We do not use Your Content to train our AI models.
5. Plans, Billing, and Cancellation
Paid plans are billed in advance on a monthly or annual basis through Stripe. You authorize us to charge your chosen payment method for applicable fees.
You may cancel at any time from your billing portal; cancellation takes effect at the end of the current billing period. We do not offer pro-rated refunds except where required by law.
If a payment fails, we will attempt to charge again and notify you. After a grace period, unpaid accounts may be downgraded or suspended.
6. Free Plan
We may offer a free plan with usage limits. We reserve the right to modify or discontinue the free plan at any time with reasonable notice.
7. Intellectual Property
The Service, including its software, design, and branding, is owned by Chattery and protected by copyright, trademark, and other laws. These Terms do not grant you any right or license to use our intellectual property except as expressly set out here.
8. Termination
You may delete your account at any time. We may suspend or terminate your access if you violate these Terms, if we are required to by law, or if continuing to provide the Service to you would pose a risk to the Service or other users. Sections that by their nature should survive termination will do so.
9. Disclaimers
The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. AI-generated responses may contain errors; you are responsible for reviewing output before relying on it.
10. Limitation of Liability
To the maximum extent permitted by law, Chattery and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue. Our aggregate liability under these Terms will not exceed the greater of (a) the fees you paid us in the twelve months before the event giving rise to the claim, or (b) one hundred US dollars ($100).
11. Indemnification
You agree to indemnify and hold us harmless from any claims arising from your use of the Service, Your Content, or your violation of these Terms.
12. Changes to the Service and Terms
We may modify the Service or these Terms from time to time. We will notify you of material changes and update the "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance.
13. Governing Law
